Muslim Ban 2.0 Waivers FOIA
FOIA Request Overview
In June 2017, Muslim Advocates submitted a Freedom of Information Act (“FOIA”) request seeking information on the application of the waiver provisions in President Trump’s Muslim Ban 2.0.
Muslim Advocates, along with the Southern Poverty Law Center, Americans United for Separation of Church and State, and the law firm Covington & Burling LLP filed this FOIA request following the promulgation of Muslim Ban 2.0. Under the terms of that policy, nationals from impacted countries were generally banned from entering the United States unless they could obtain a case-by-case waiver. To date, the federal government has produced very little information about how individuals can apply for waivers and how those applications will be evaluated by consulate officials.
This FOIA request was submitted to the U.S. Department of State, U.S. Department of Homeland Security, and U.S. Customs and Border Protection. Muslim Advocates has filed litigation seeking to compel the government to comply with this FOIA request.
